Two Four Star Generals Write New York Times Op-ed Against NDAA and Indefinite Detention of Americans

4 Star Generals Warn Against Against NDAA Indefinite Detention

The Intel Hub
December 21, 2011

Two retired four star Marine generals have written a stunning op-ed in the New York Times which demands that President Obama veto the National Defense Authorization Act, a bill that allows the government to use the military to indefinitely detain American citizens without due process.

Charles C. Krulak and Joseph P. Hoar, both 4 star Marine generals, published the piece on December 12. The op-ed starts with a direct demand that President Obama veto the NDAA bill in order to protect our country from the “false choice between our safety and ideals.”

It then gets into one of the most blatant anti American treasonous provisions in the history of the United States.

One provision would authorize the military to indefinitely detain without charge people suspected of involvement with terrorism, including United States citizens apprehended on American soil. Due process would be a thing of the past.

Some claim that this provision would merely codify existing practice. Current law empowers the military to detain people caught on the battlefield, but this provision would expand the battlefield to include the United States — and hand Osama bin Laden an unearned victory long after his well-earned demise.

The generals then go on to cite the fact that most in the military have not even asked for this extreme new power.

Sadly, many at the Pentagon are openly planning on unleashing the military on the American people and if we do not see more high level military personal speak out against this and other tyrannical bills America is finished as we know it.

  1. This is interesting. And in the NYT. Sometimes they do their job.

  2. Allison says:

Brave Patriots! We need more military personnel to come forward and stand up to this unConstitutional bill! Martial Law is here, they are preparing to take to the streets, police are being equipped, Amerika will become East Germany 2.0 if we do not rise up as a unified front to these fascists now!

    • bill says:

they have been militarizing our police for the last ten years, this has been there plan all along, to pull us into a totalitarian system of fascism. this is no longer a joke or some passing fad, there gearing up to kill us if you buck the progressive system they set up.

      • Mark says:

Progressiveness and fascism are polar opposites sir. We must “buck” Corporatism, which is in fact fascism in its purest form.

        • Anthony Smith says:

You, sir, are mistaken. I’m really not interested in arguing the finer points of political philosophy, but your lack of acumen is definately showing.

  3. Randy says:

Hopefully, our men and women in service will remembers these words – (officers)
“I, [name], do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God.”

“I, XXXXXXXXXX, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; and that I will obey the orders of the President of the United States and the orders of the officers appointed over me, according to regulations and the Uniform Code of Military Justice. So help me God.”

Enlisted – “orders of POTUS and officers” remember that the officer’s oath is directly sworn for the Constitution not POTUS orders.

    • The Constitution specifies the Oath of officers of the United States but not the oath of enlisted soldiers; an oversight corrected by our friends at http://www.OathKeepers.org

    • Brent Cole says:

You need to do a statutory construction from 5 USC sec 3331. it is suppose to be:
I, Brent Cole, do solemnly swear that I have never voluntarily borne arms against the United States since I have been a citizen thereof; that I have voluntarily given no aid, countenance, counsel, or encouragement to persons engaged in armed hostility thereto; that I have neither sought, nor accepted, nor attempted to exercise the functions of any office whatever, under any authority or pretended authority, in hostility to the United States; that I have not yielded a voluntary support to any pretended government, authority, power, or constitution within the United States, hostile or inimical thereto. And I do further swear that, to the best of my knowledge and ability, I will support and defend the Constitution of The United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion, and that I will well and faithfully discharge the duties of the office of statutory Attorney General, on which I am about to enter, So help me God.

      That is mine.
From 14 Stat. Ch. 31, Sec. 1756, et seq.
TITLE XIX. PROVISIONS APPLICABLE TO SEVERAL CLASSES OF OFFICERS. (Revised Statutes)
      1873 -1874;

“ I, A B, do solemnly swear (or affirm) that I have never voluntarily borne arms against the United States since I have been a citizen thereof; that I have voluntarily given no aid, countenance, counsel, or encouragement to persons engaged in armed hostility thereto; that I have neither sought, nor accepted, nor attempted to exercise the functions of any office whatever, under any authority or pretended authority, in hostility to the United States; that I have not yielded a voluntary support to any pretended government, authority, power, or constitution within the United States, hostile or inimical thereto. And I do further swear (or affirm) that, to the best of my knowledge and ability, I will support and defend the Constitution of The United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion, and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God.” [Sec. 1757 is repealed]
“Sec. 1758.The Oath of office required by either of the two preceding sections may be taken before any officer authorized either by the laws of the United States, or by the local municipal law, to administer oaths, in the State, Territory, or District where such oath may be administered. [See § 2617.]”

“Sec. 1760. No money shall be paid from the Treasury to any person acting or assuming to act as an officer, civil, military, or naval, as salary, in any office when the office is not authorized by some previously existing law, unless such office is subsequently authorized by law.” …
“Sec. 1762. No money shall be paid or received from the Treasury, or paid or received from or retained out of any public moneys or funds of the United States, whether in the Treasury or not, to or by or for the benefit of any person appointed to or authorized to act in or holding or exercising the duties or functions of any office contrary to sections seventeen hundred and sixty-seven to seventeen hundred and seventy, inclusive; nor shall any claim, account, voucher, order, certificate, warrant, or other instrument providing for or relating to such payment, receipt, or retention, be presented, passed, allowed, approved, certified, or paid by any officer, or by any person exercising the functions or performing the duties of any office, or exercising or performing the duties of any office or place of trust under the United States, for or in respect to such office, or the exercising or performing the functions or duties thereof.

Every person who violates any part of the provisions of this section shall be deemed guilty of a high misdemeanor, and shall be imprisoned not more than ten years, or fined not more that ten thousand dollars, or both.”

The bill is bad to the bone. Pure 100% bonafide and certified evil.
Straight out of hades where it was forged with malice and cruelty.
It will corrupt whomever wields it’s power.
It has a mind of it’s own. It will even betray it’s wearer.
It has visited many before us.
It will destroy as much as it can.
It has no other purpose and it only has but 1 master.
    It does not share power.
We’ve all seen the movie and we know how it’s supposed to end.

  5. Al says:

At least we’ll have some military brass helping us devise a way out of the camps, that’s good to know.

  6. Chuck says:

Anyone supporting the NDAA should be tried for violation of their Oath of Office and for Treason.

    Semper Fi

I figured it would be my old Alta Mata that would step up to the plate. As a retired US Marine I often wondered if I would some day face off with another Marine regarding our Constitution – Declaration of Independence and Bill of Rights. It looks like my fears have been relieved, my fellow Marines have other ideas and clearly they are true patriots. I salute you Generals Krulak and Hoar and I am proud to be a member of the club.

    Semper Fi !

  9. Eagle says:

I am glad to see some people in the military knowing what is right and wrong. I truly hope there will be a million more that follow. I wish for a peaceful end to tyranny. There are some very corrupt people in US politics. There needs to be an utter purge. UTTER!

  10. Sovereign says:

When will Americans wake up. Any law repugnant to the Constitution is null and void ab initio….from the beginning….(This goes for most of the crap coming out of congress.) We the People are in charge, NOT those lamebrains on the hill. All who voted for this horrendous bill have violated their oath of office and are no longer deserving of the office they hold.

  11. amigo says:

    Hello friends,

As you know the signing of this bill by Obama will essentially declare the rights of citizens of America practically null and void. It will not be the US military who will be policing US citizens. It will be PRIVATE CONTRACTORS from Xe, formerly Blackwater. It will also include the UN if there are ever such riots that cannot be supressed by our treasous-military combat armed police forces. The DHS are the terrorists. They need to be stopped. They were hoping to suspend your 2nd Amendment rights through the botched “fast and Furious” gun running campaign. The media is complicit and can not be trusted. Nor can any of your elected Congressmen with the exception of the few Senators and House Reps who did not vote for this treasonous, totalitarian, communist piece of trash. Tyranny occurs when the people are afarid of their government. Thomas Jefferson (considered a traitor by our own DHS and federal government today) would have us feed the tree of liberty with their blood. I thought T.J. was a patriot, a true American, one whom John F. Kennedy, the last great US President to not give int to globalist blowhards said, was the smartest to ever live at the White House.

People there are only two people who I would like to meet in all of history, Jesus Christ, and Thomas Jefferson. Amen.

  12. Ha'ashkee Dahzii Ya'ai Jii says:

The NDAA will void the Constitution and Bill of Rights. Therefore, when a patriot joins the military and takes the oath to uphold the Constitution she or he won’t have the right under the law to oppose anything they are ordered to do. Just stop obeying the government right now – everyone.

  13. Howard T. Lewis III says:

Who did 9-11? The head of the octopus. Let’s put this to bed.

  14. Robert C. Laity says:

ANY LAW that is REUGNANT to the US Constitution is null and Void”-Marbury v. Madison,USSCt.(1803(

The NDAA IS “REPUGNANT to the Constitution”.

  15. Antiquechrisss says:

You have to sign into the NY Times, create an account and look for “Guantánamo Forever?” The article is there.

  16. steve smith says:

with regards to the oath that soldiers took when joining the military where it states: , i do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic. the members of congress are in fact or should be seen as domestic terrorists as they are trying to destroy your constitution and put in laws that defy and destroy your bill of rights so it should be them that are detained indefinately without trial. all it’d take is a group within the military that pushes for this then maybe they would think twice?

  17. Daniel R. Martin says:

The President must veto this NDAA bill if we are to maintain a free society. Are we becoming so panicky that we are willing to submit to a fascist form of govrrnment? I think not. To relinquish our rights as citizens is intolerable. If passed, I pray it.will be found uncontitutional by the Supreme Court, however, my faith in that branch of government, based on recent decisions is not great.

  18. Peter Gatliff says:

These generals can see the writing on the wall. The far right in 1934 attempted a coup d’tat in 1934 to over throw the US and make the US into a fascist state. It was called the “Business Plot”. Today the same political ideology is running rampt threw the far right. The generals are warning the people of the US Fascim is coming to America.

Not well said, but correct on many levels. This empire is going down the crapper like all others before it. How did the U.S. get so powerful? The same way they all do, sociopaths rise to the top, as the all ways do. They all ways ruin it too, even before it started this experiment was doomed.

  21. Lil says:

Oathkeepers.org has launched an effort to RE-CALL every demorat and republican who voted yes for this bill. Do a search on “how to recall member of congress”
and you will see what actions the states can take against these commies in power. Check out Oathkeepers.org too. Great Patriots.

  22. Rick says:

I don’t trust the police in this country one bit. They have been militarized and the vast majority of them are all too willing to go against the American people and the constitution. Yes, there are many good sheriffs and a small percentage of law enforcement who will not go along but those will be executed or forced into submission to a large degree when the time comes. Among the military and National Guard, I think many of them will go along with the plan at least at first and while they look like they are winning. I hate to say it but our military personnel are not the men their fathers were. My biggest hope lies with the Marines who have a much higher standard of conduct than the rest of the military. After the initial assault and the American version of “The night of long knives”, the powers that be and those who partake in the injustice will suffer great losses and the battle will quickly turn to our favor. Be prepared.

If anonymous is so capable how come they dont know about the mass homebuilt computers (so as not to be on record) financed by overseas and inside us soil corrution placed under public storage ‘units’ drilling through the floors or the computer chips smuggled into the us on the tags of oriental blankets during coordinated attacks from within and outside the internet goes down then they come up and they have internet and the american people dont. Why doesnt anonymous know about this and wheres the stockpiles????

  24. Ray Terry & Daughter, Shona says:

The time has come for all real people of Freedom to stand up and step forward. To our U.S. Military who are our Fathers and Mothers, Sons and Daughters. You come from the ranks of the American People. You are the guardians and high protectors of the American People and the Constitution. Back to the beginning of the battles of Concord and Lexington, Yorktown, the Battles of Saratoga and Ticonderoga through the Civil War, World War 1and 2, and the Vietnam War. Hundreds of thousands of American Military Men and Women have laid down their lives for a belief in Freedom and support of the Constitution. Do not let their blood shed be in vain. The rogue government in Washington does not care about you. They send you to far off lands to bleed and die for the Banking Cartel and the military industrial complex who run and control the government. They betray you by dumping your bodies in landfills and through your Veterans benefits. This is the way they treat you. Henry Kissinger once stated “Military men are dumb, stupid animals to die and be used as pawns for foreign policy.” I hope he dies with the same and guilt for what he really is…..
The American People will never betray you for we are you and you are us!!
